Punishment for Non-Registration (Section 3)<\/strong><\/h2>\n\n\n\n<ul>\n<li><strong>Penalty:<\/strong> Up to <strong>10% of the estimated cost<\/strong> of the real estate project as determined by the Authority.<\/li>\n\n\n\n<li><strong>Further Punishment:<\/strong> If the promoter continues the violation, punishment may include <strong>imprisonment up to 3 years<\/strong> or an additional fine up to <strong>10% of the project cost<\/strong>, or both.<\/li>\n<\/ul>\n\n\n\n<p><strong>2. Penalty for False Information (Section 4)<\/strong><\/p>\n\n\n\n<ul>\n<li>If a promoter provides false information or contravenes Section 4, they shall be liable for a penalty of up to <strong>5% of the estimated project cost<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>3. Penalty for Contravention of Other Provisions (Section 61)<\/strong><\/h2>\n\n\n\n<ul>\n<li>For violations <strong>other than Section 3 &amp; 4<\/strong>, the penalty can be up to <strong>5% of the project cost<\/strong> as determined by the Authority.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>4. Non-Compliance by Real Estate Agents (Sections 9 &amp; 10)<\/strong><\/h2>\n\n\n\n<ul>\n<li><strong>Daily Penalty:<\/strong> \u20b910,000 per day for continued non-compliance.<\/li>\n\n\n\n<li><strong>Cumulative Penalty:<\/strong> Can extend up to <strong>5% of the cost of the property<\/strong> involved in the transaction.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>5. Failure to Comply with Authority Orders (Section 63 &amp; 65)<\/strong><\/h2>\n\n\n\n<ul>\n<li><strong>For Promoters &amp; Agents:<\/strong> A penalty of up to <strong>5% of the project cost<\/strong> for non-compliance with Authority directives.<\/li>\n\n\n\n<li><strong>For Allottees (Section 67):<\/strong> A penalty up to <strong>5% of the property cost<\/strong> for failure to comply.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>6. Failure to Comply with Appellate Tribunal Orders (Sections 64, 66 &amp; 68)<\/strong><\/h2>\n\n\n\n<ul>\n<li><strong>Promoters:<\/strong> Imprisonment up to <strong>3 years<\/strong> or daily fines up to <strong>10% of the project cost<\/strong>.<\/li>\n\n\n\n<li><strong>Real Estate Agents:<\/strong> Imprisonment up to <strong>1 year<\/strong> or fines up to <strong>10% of the project cost<\/strong>.<\/li>\n\n\n\n<li><strong>Allottees:<\/strong> Imprisonment up to <strong>1 year<\/strong> or fines up to <strong>10% of the property cost<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>7. Offences by Companies (Section 69)<\/strong><\/h2>\n\n\n\n<ul>\n<li>If an offence is committed by a company, persons responsible (Directors, Managers, Officers) are deemed guilty unless they prove lack of knowledge or due diligence.<\/li>\n\n\n\n<li>If an offence is committed with consent or negligence of a director\/manager, they are also deemed guilty.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>8. Compounding of Offences (Section 70)<\/strong><\/h2>\n\n\n\n<ul>\n<li>Certain punishments (excluding imprisonment) may be <strong>compounded by the court<\/strong> with prescribed payment, not exceeding the maximum fine applicable.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>9. Power to Adjudicate (Section 71)<\/strong><\/h2>\n\n\n\n<ul>\n<li><strong>Adjudicating Officer:<\/strong> A judicial officer (District Judge) appointed to adjudicate compensation cases under <strong>Sections 12, 14, 18, &amp; 19<\/strong>.<\/li>\n\n\n\n<li><strong>Decision Timeline:<\/strong> Cases should be resolved within <strong>60 days<\/strong>; delays must be justified in writing.<\/li>\n\n\n\n<li><strong>Inquiry Powers:<\/strong> Can summon witnesses and demand documents.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>10. Factors Considered for Compensation (Section 72)<\/strong><\/h2>\n\n\n\n<ul>\n<li><strong>Unfair gains from default<\/strong> (where quantifiable).<\/li>\n\n\n\n<li><strong>Loss incurred due to default<\/strong>.<\/li>\n\n\n\n<li><strong>Repetitive nature of violations<\/strong>.<\/li>\n\n\n\n<li><strong>Other factors ensuring fair justice<\/strong>.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>1.
